The Dark Scimitar is obtainable anywhere you find a binary and finite cluster in a phantom inventory. I know the Azado 12F location works, probably Pentagulia Dock and the 2 Taben's Peak locations, too. Check the "Bug Activation Locations" section of my site for more info about that. The problem is, I don't know how much my saved games messed with the bug.
Unfortunately, yes, the Dark Scimitar is obtained through "luck of the draw". You have to cycle through the items in the infinite cluster and hope that it shows up.
